Using Rally responsibly.
Effective:
These Terms are a binding agreement between you and Rally. They explain what Rally provides, what we expect from players, and how responsibility is allocated when you use a free service to arrange in-person recreational tennis.
Tennis and meeting people offline involve real risks. Rally is provided free of charge, as is and as available, and Rally does not organize, supervise, or guarantee games.
1. Agreement and eligibility
By creating an account, checking the agreement box during registration, or using Rally, you agree to this Agreement, our Privacy Policy, and our Community Guidelines (collectively, the “Rally Policies”). Continued use of Rally constitutes acceptance to any updates to the Rally Policies. If you do not agree, do not use Rally.
Rally is intended for adults arranging lawful, recreational tennis, primarily in the Greater Boston area (including Boston, Cambridge, Somerville, Brookline, Newton, Quincy, and nearby communities). You must be at least 18 years old and have the legal capacity to enter into this agreement as of the date you begin using Rally. You must only use your own account, provide accurate information, maintain responsibility for activity under your own account and keep your sign-in credentials secure. Willfully providing inaccurate or misleading information, and committing harassment, fraud or impersonation are each expressly prohibited.
2. What Rally provides
Rally is a technology service that helps players discover, post, join, share, and coordinate recreational tennis games. It may provide estimated matches, distances, travel times, court suggestions, weather information, calendar links, messages, and email alerts.
Rally is not a tennis organizer, club, coach, medical provider, transportation provider, court owner, booking agent, insurer, employer, or emergency service. Rally does not:
- organize, host, supervise, officiate, or attend games;
- reserve, inspect, maintain, control, or guarantee access to any court;
- conduct criminal, identity, health, or other background checks;
- verify a player's identity, age, skill, fitness, statements, availability, intentions, or conduct; or
- guarantee that a game will happen, be safe, be suitable, or match any description.
Court availability, booking rules, access, fees, conditions, maps, routes, weather, distances, fit scores, and third-party information can be incomplete, delayed, or wrong. Choosing a court in Rally does not reserve it. Confirm important details yourself before traveling or playing.
Free service; no payments or compensation
Rally is currently free. Rally does not charge users, process payments between users, or collect court, travel, equipment, medical, data, or other expenses. You are responsible for your own costs. Because there are no Rally fees, there are no refunds, credits, reimbursements, or promised compensation, and you are not entitled to payment for using Rally, submitting content or feedback, experiencing an interruption, or participating in a game.
We may add, change, suspend, restrict, or discontinue any feature or the entire service at any time, with or without notice. We do not promise that Rally or any particular feature will always be available.
3. Your responsibilities
You decide whether, where, when, and with whom to play. Use your own judgment, communicate changes promptly, inspect the court and equipment, consider weather and travel conditions, play within your abilities, and obtain any medical advice you need. Meet in appropriate public places, follow posted court rules and applicable law, and contact local emergency services—not Rally—when immediate help is needed.
You must not use Rally to:
- harass, threaten, discriminate against, stalk, exploit, or harm anyone;
- impersonate another person, misrepresent material facts, or create deceptive accounts or games;
- share another person's private information without permission;
- spam, solicit payments, advertise unrelated services, or arrange activities other than recreational tennis;
- upload unlawful, infringing, malicious, or harmful content;
- scrape, probe, disrupt, reverse engineer, bypass access controls, or misuse Rally's systems; or
- violate any law, court rule, court policy, third-party right, or these Terms.
Use Rally's report and block tools when appropriate. Blocking helps limit contact inside Rally but cannot control conduct outside the service. We may review reports, preserve relevant records, restrict features, remove content, suspend accounts, or contact authorities when we reasonably believe it is necessary for safety, security, legal compliance, or enforcement.
4. Your content, game links, and Rally property
You keep ownership of content you submit, such as profile information, game descriptions, messages, reports, court corrections, and feedback. You represent that you have the right to submit it. You grant Rally a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, transmit, and otherwise use that content only as reasonably necessary to operate, secure, moderate, improve, and provide Rally and to comply with law. This license ends when the content is deleted from active systems, except where continued retention is described in the Privacy Policy or required by law.
Public and private games can have shareable links. A public game may appear in Discover and search or social previews. A private game stays out of Discover and is marked not to be indexed, but anyone who obtains its link can view the shared game details and can pass the link to someone else. Do not put sensitive personal information in a game description or other shareable field.
Accepted players can read the game thread and see information needed to coordinate. You are responsible for what you share and for respecting information shared by others. Rally cannot prevent recipients from copying or redisclosing information they can access.
When you submit early-access feedback, ideas, or suggestions, Rally may use them without restriction, payment, attribution, or compensation. Rally is not required to implement or respond to feedback.
Rally's software, design, branding, compilation of court information, and other service materials are owned by or licensed to Rally and are protected by applicable law. These Terms give you only a limited, personal, revocable, non-transferable right to use Rally as intended.
5. Assumption of risk and release
You voluntarily choose to use Rally and participate in in-person tennis activities. You understand and assume all risks arising from or related to that choice, whether known or unknown, including strenuous activity, falls, collisions, balls or equipment, court defects, weather, travel, illness, theft, property damage, the acts or omissions of other users or third parties, and the possibility of serious bodily injury, disability, or death.
To the fullest extent permitted by law, you release and agree not to hold liable Rally and its creators, operators, developers, administrators, volunteers, affiliates, licensors, and service providers (together, the “Rally Parties”) from claims, demands, losses, injuries, damages, costs, or causes of action arising out of or relating to:
- your use of or inability to use Rally;
- any game, meeting, communication, dispute, or interaction with another user;
- travel to or from a game, any court or facility, equipment, weather, or playing tennis;
- user content, inaccurate information, recommendations, routes, forecasts, alerts, or third-party services; or
- the ordinary negligence of a Rally Party connected with the service or these activities.
This assumption of risk and release is intended to be as broad as applicable law permits. It does not release liability that cannot legally be released, including liability for a Rally Party's gross negligence, reckless or intentional misconduct, fraud, or other non-waivable conduct.
6. Disclaimers and limitation of liability
To the fullest extent permitted by law, Rally is provided “as is” and “as available,” without warranties of any kind, express, implied, or statutory. The Rally Parties disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, quiet enjoyment, and any warranty arising from course of dealing or usage of trade.
The Rally Parties do not warrant that Rally will be uninterrupted, error-free, secure, or free of harmful components; that data will never be lost or accessed without authorization; or that users, games, courts, routes, forecasts, communications, or results will be accurate, safe, reliable, or suitable.
To the fullest extent permitted by law, the Rally Parties will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, opportunities, goodwill, use, or data; personal injury, death, emotional distress, or property damage; or any damages arising from user conduct, games, travel, courts, content, third-party services, unauthorized access, or service interruption.
To the fullest extent permitted by law, the Rally Parties' total aggregate liability for all claims relating to Rally or these Terms will not exceed the total amount you paid directly to Rally during the 12 months before the event giving rise to the claim. Rally is free, so that amount is currently $0.
Some laws do not allow certain warranty exclusions, releases, or liability limitations. In that case, the exclusions and limits above apply only to the maximum extent allowed, and nothing in these Terms limits any consumer protection or other right that cannot lawfully be waived.
Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Rally Parties from third-party claims, liabilities, damages, judgments, losses, and reasonable legal costs arising from your content, your conduct or interactions, your misuse of Rally, or your violation of these Terms, law, or another person's rights. This obligation does not apply to the extent a claim results from a Rally Party's own non-indemnifiable conduct.
7. Suspension, deletion, and other legal terms
You may stop using Rally at any time and may delete your account from Profile. Deletion and retention are explained in the Privacy Policy. Rally may suspend or terminate access, remove content, or take protective action when we reasonably believe you violated these Terms, created risk, exposed Rally or others to liability, or when needed to protect the service. Provisions that by their nature should survive will survive, including ownership, feedback rights, risk allocation, releases, disclaimers, liability limits, indemnity, and governing law.
We may revise these Terms as Rally changes. The updated Terms will show a new effective date. When reasonably practicable, we will provide additional notice of material changes. Your continued use after revised Terms take effect means you accept them; if you do not agree, stop using Rally and delete your account.
Delaware law governs this Agreement, without regard to conflict-of-law principles, except where the law where you live gives you non-waivable rights. This Agreement does not require arbitration and does not select an exclusive court or venue.
If any provision is unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without Rally's consent; Rally may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the service. These Terms, the Privacy Policy, and the Community Guidelines are the entire agreement about your use of Rally.
